This disclaimer will act as a statement intended to specify or delimit the scope of rights and obligations that may be exercised and enforced by Treefrog Interactive Inc. in a legally-recognized relationship with its clients.
Disclaimer of Warrantee
Treefrog prides itself on compelling end products. With this regard, we provide a 30 day warrantee on workmanship for the websites that we create.
Limitation of Warrantee
Treefrog’s 30 day workmanship warrantee covers clear deficiencies or “bugs” with the product created. It does not cover “upgrades” or “add features” after approval of the site.
Limitation of Liability
Treefrog Interactive Inc. shall not be held responsible for any direct, indirect, incidental or consequential damages that may result from anything as a result of a project created by Treefrog Interactive (e.g. website). Treefrog will be held harmless of indemnity in agreements.
Force Majeure
This clause frees both parties from liability or obligation when an extraordinary event or circumstance beyond the control of the parties, such as a war, strike, riot, crime, or an event described by the legal term "act of God" (e.g., flooding, earthquake, volcanic eruption), prevents one or both parties from fulfilling their obligations under the contract.
Ownership of Content
It is our policy, not to use third party content without explicit consent or purchase the rights to use said content. Any content received from clients must have a signed agreement indicating that they own all material being posted to their site. Content is not to be plagiarized or taken in any part from other sites. Any content put up by clients on their own site is subject to our LEAP™ disclaimer which states that "You control your own content, therefore own all liability associated with it's being on your website.
Any content under dispute will be immediately removed from the offending site unless explicitly told by the client to leave in place, in which case they assume all liability for its existence. We assume no liability before or after it is removed.
We take no responsibility and assume no liability for the content which is placed on the websites of our clients - including content we create, which may or may not have been created from materials we were not aware had limitations on usage.
